Privacy Policy

This Privacy Policy applies to information collected from you through the domain and subdomains of www.spearphotoart.com (the “Site”) and may be updated at any time without notice to you. By accessing or using the Site, you accept the data practices described in this Privacy Policy and any future updates to the policy.

1. Collection of Your Personal Information: In general, you may browse the Site without telling us who you are or providing us with any personal information about yourself. If you choose to make a purchase through this Site, we will then ask you to create an account, a username and a password; we will also ask you to provide certain personal information (such as your name, home address, e-mail, and telephone number) that is necessary to process your order.

We use PayPal to process online payments. When you place an order and choose PayPal as your payment method, you will be directed to submit billing and payment information (such as your credit card number) through PayPal. Please be aware that the collection and use of such information is governed by PayPal’s privacy policy, not ours.

2. Use of Your Personal Information: Frank Spear Photographic Arts (“FSPA”) collects and uses your personal information to operate and improve our Site, to process and fulfill your orders, and to provide customer service. We may also send transaction-related communications such as welcome emails, order confirmations, and shipping notices. By accepting this Site’s Terms of Use and this Privacy Policy, you expressly agree to receive this information.
We will not send you marketing or promotional communications, unless you opt in to receiving such information. You can discontinue future promotional emails by following the specific unsubscribe instructions in the communications you receive.

3. Sharing Your Personal Information: Except as disclosed in this Privacy Policy, FSPA does not share your personal information with any third parties.

We may share your personal information with service providers who perform services on our behalf. For instance, we may engage other companies to host our Site, to provide data storage, to process payments, and to fulfill orders and shipments. Those companies will be permitted to obtain only the personal information necessary for them to provide the service. They will be required to maintain the confidentiality of the information.

Information about our customers, including personal information, may be disclosed to a third party who acquires all or a substantial portion of our business, whether such acquisition is by way of merger, consolidation or purchase of all or a substantial portion of our assets. In the event we become the subject of a bankruptcy proceeding, personal information will be disposed in a transaction approved by the bankruptcy court. Additionally, we reserve the right to disclose your personal information if we determine, in our sole discretion, that such disclosure is necessary to: (i) comply with the law or respond to a legal process served on FSPA; (ii) protect and enforce our rights under our agreements or policies governing your use of the Site; or (iii) act in urgent circumstances to protect the personal safety of FSPA’ customers or the public.

We may also disclose aggregated, non-personally identifiable information about our customers to third parties.

4. Security of Your Personal Information: The security of your personal information is important to us. We have implemented commercially reasonable measures to protect your personal information from unauthorized access, use, alteration, or disclosure. However, we cannot guarantee that our security measures are able to completely prevent unauthorized third parties from obtaining and using your personal information for improper purposes.

It is your sole responsibility to maintain the confidentiality of any user name or password which is registered in connection with your use of the Site. We recommend you change the password immediately if you believe it has been compromised and log out of your account and exit your browser when finished using a shared computer.

Use of Cookies: FSPA may use “cookies” to automatically collect certain information from you, such as your IP address, browser type and language, registration information, and your purchase history. Cookies are small text files that are placed on your hard drive by a web server. Cookies allow us to identify registered customers when they return to the Site and eliminate the need for customers to repeatedly enter the same information. You may choose to decline cookies by modifying your browser setting, but you may not be able to use some of the features on our Site that depend on cookies if you do so.

6. Children: We do not solicit personal information from children. If you are not 18 or older, you are not authorized to use this Site.

7. Links: We may link to other websites (including websites of our affiliates) that have different privacy policies and practices from those disclosed here. We are not responsible for the privacy policies or practices of other websites to which you choose to link from our Site, and encourage you to become acquainted with them prior to use.
